This claim, drawn from Rainer Plaga's 2008 critique of the LHC safety analyses, holds up in one respect and fails in another, and where a reader lands depends on how strong a standard "establish" is taken to impose.
Plaga's concrete case has not survived scrutiny. His metastable black-hole scenario, in which a slowly decaying collider-produced black hole could accrete matter and emit dangerous radiation, was rebutted in detail by Giddings and Mangano, who showed it mixes Hawking-radiation and accretion formulas in a physically inconsistent way; the authors of the very theoretical framework Plaga invoked (Casadio, Fabi and Harms) reached the same conclusion. The astrophysical bounds from the survival of white dwarfs and neutron stars, which Plaga argued his scenario escapes, are generally held to cover it. His unpublished rejoinder gained little traction, and the specific hazard he described is widely regarded as excluded.
A more general methodological point, however, remains credible. Ord, Hillerbrand and Sandberg argued that no theoretical safety analysis can certify a catastrophe probability far below the probability that the analysis itself contains an error in its theory, models, or calculations. On a strict reading, published analyses alone therefore cannot establish that the risk is negligible in the strongest sense, though the LHC safety case combines several partly independent lines of argument (black-hole decay theory, cosmic-ray bombardment, stellar survival), which pushes the combined bound lower than any single argument allows.
